What is no win no fee?

A no win no fee agreement is the contract between you and your legal team. Also known as a conditional fee agreement, it takes the financial risk out of making a claim. You don't have to pay any upfront fees and you only pay anything if your claim is successful. That's right – if your claim is unsuccessful, you won’t have to pay a thing!

Generally, you have three years from the date of your accident or injury to start proceedings or settle a claim for no win no fee compensation. If you don’t make your claim within three years, you will be what’s known as ‘time-barred’ and will be unable to proceed.

There are a few exceptions to this rule, which are:

  • There's no time limit if you're making a no win no fee claim on behalf of someone who doesn't have the mental capacity to make a claim themselves because of their injury or a pre-existing medical condition. The only exception to this is if they regain mental capacity, even for a brief time period. In this situation, the three-year time limit begins
  • If your claim is for an illness, rather than an injury and so was not immediately apparent – for example, an industrial disease related to a current or former workplace – the three-year limit will apply from the date when the symptoms were first noticed.
  • If a child was aged under 18 years when their accident happened, you can make a claim on their behalf up u
