Railway accident claim FAQs

No two claims are the same, but generally speaking, claims need to have been settled within three years, or court proceedings need to have been started within this time. This period is also known as the 'limitation period'. As with any claim, the sooner you start the process, the better – especially as your memory of the events will likely be clearer.

There are a few exceptions to this three-year rule. These are most often when claiming on behalf of someone else, for example:

  • Claiming for a child - a person under 18 cannot claim on their own, but as their legal guardian you can help. In these cases you can start their train accident claim on their behalf at any time
  • before their 18th birthday. After they turn 18, they can claim on their own - they'll have until they turn 21 to settle or start court proceedings.

However, if the person regains mental mental capacity at any point, the three-year time limit will start from then, and the clock will keep ticking, even if they lose capacity again.
  • Seeking justice after a loved one's death - when a fatal injury caused by a train accident has caused the death of your loved one, you can claim compensation on their behalf, which can recover any finances lost as a result of their death. In these cases, the three-year limit applies and is calculated from the date they died, or the date it became clear that the train accident was the cause.
