A no-upfront-cost insurance policy will be taken out that protects you from costs and expenses which you might otherwise have to pay during the claims process. You'll be protected as long as you stick to the terms of the agreement and follow all advice given."

So, if your claim is unsuccessful for any reason, you won't be left trying to fetch a bunch of fees (as long as you've stuck to the terms of your no-upfront-cost insurance agreement, of course).

You generally have three years from the date of the incident to make a claim. You must either settle your claim or start proceedings within this time.

It’s best to claim as soon as possible for a couple of reasons. We all forget things and our memories can get a bit hazy, so starting your claim as early as possible means events will be clearer. It also means any evidence is likely to be easier to gather.

You can claim on behalf of another person in certain situations:

If the injured party is a child, you can make a claim on their behalf at any time up until their 18th birthday. After this, they have until they reach 21 to either start court proceedings or settle a car or taxi passenger accident claim themselves.

If the injured party lacks the mental capacity to make a claim themselves, someone else can do so on their behalf and there are no time limits. But, if they regain mental capacity, even for a short time, the three-year time limit starts from that point.

If you’re making a claim on behalf of a loved one who has suffered a fatal injury, you have three years from the date of their passing, or from the date it was discovered the accident was the cause. You will need to start proceedings or settle the claim in these three years.
