What is a factory accident?

Factory accidents happen in the workplace and can sometimes be pretty nasty. I've helped people just like you claim for injuries such as fractures and broken bones.

What causes factory accidents?

Many things can cause an accident in a factory. If any of these happened to you, let me and my team get you some answers:

  • Slips, trips and falls: Perhaps you slipped on a wet floor due to lack of signage while you were fetching some boxes? Or maybe you weren't provided with the right footwear? Slips and trips are some of the most common accidents in a workplace.
  • Machinery: Working with machinery can be dangerous. You should have been trained properly on how to use it. And your boss should make sure it's safe, according to the Health and Safety Executive guidance.
  • Lack of personal protective equipment: Just like I should have a collar when roaming the streets, you should be given PPE to make sure you stay safe while at work. If this didn't happen, talk to me and let's see if you can make a factory accident claim for free.
  • Electric shocks: Working with electrical equipment in a factory can be dangerous if people don't stick to the rules. If you've been injured from an electric shock, you could claim.

If your factory accident happened as a result of something else, then fear not. Chances are I can still help you claim if someone else was at fault.

What injuries can I help you claim for?

Here's a list of some common factory injuries that you could get compensation for:

  • Fractures or broken bones
  • Bruising or cuts
  • Sprains
  • Head injuries
  • Eye injuries
  • Burns
  • Crush injuries
  • Fatality

If your injury isn’t listed here, don't worry. Whatever your injury, give me a ring on [Medtel] and I or a member of my team will chase up the compensation you deserve.

But whose fault was it really?

In some cases, it will be obvious who was to blame for your factory accident. The Health and Safety at Work Act 1974 is there to keep people like you safe at work. But if your boss didn't do what they were supposed to, it could have led to your accident. This means that they might be responsible and you could make a claim.

If you're not sure who was to blame, I can help you get to the bottom of your accident. You might even be able to claim factory accident compensation if your boss was only partly at fault.

Worried you'll get sacked for making a claim?

Making a claim after a work accident can't get you fired. In fact, it shouldn't affect your job at all as there are laws in place to make sure you can't be treated any differently for speaking up or claiming factory accident compensation.

So don’t be treated like an underdog. Let me help you get back on your feet by claiming the compensation you deserve.

"You can’t get sacked just because you claim for compensation against your employer. It’s called 'protection from victimisation' and you're covered by the Employment Rights Act 1996 and the Equality Act 2010. These laws mean you have the right to fair treatment and a safe workplace. If they do try to dismiss you, they’re the ones breaking the law."

So, why should you make a factory accident claim?

Being injured can drive you barking. If you've suffered after a factory accident, you've probably had some time off work, which means you might also be out of pocket. Or maybe you've had to pay for treatment, travel expenses or care? Claiming factory accident compensation can reimburse these costs. Claiming from an employer can also help to make sure that the same thing doesn't happen to anyone else.

Don't just lie down and roll over, talk to me on [Medtel] and let's figure out if we can get you some compensation.

Want to know how much factory accident compensation you could get?

I'd love to tell you exactly what you might get but everyone's claims are different so it's impaw-ssible to say. But it might be useful to know that factory accident compensation is usually split into two categories:

  • Compensation for your suffering: This part covers the direct impact on your day-to-day life such as the pain you've suffered.
  • Compensation for any financial losses: This part covers your loss of income and any other costs relating to your accident and injury.

I or one of my team can give you more of an idea of the amount you can expect once we know more about your case. Or, if you prefer, you can use my trusty compensation calculator to see a ruff estimate.

How to start a factory accident claim

Ready to claim? I've made the process as simple as possible, from starting your claim to putting you in touch with your factory accident legal team.

As a guide, here's what you can expect from the process:

  1. Call my team - Pick up the phone and call my team on [Medtel] for free or, if you prefer, you can fill in the call-back form and someone will get back to you. Advice is free and impartial so think of us like your faithful companions
  2. Tell my team about your case - My team will ask you some questions about your factory accident and take down the details of your case. They'll also be able to tell you whether they think you can make a claim.
  3.  I'll pass you over to our panel of expert solicitors - Your dedicated legal team will take your case from here. But don't worry, you'll still be in safe paws. They have lots of expertise and experience in handling claims like yours.
  4. Your legal team investigates - Your legal team will ask for any evidence you might have that will help with your claim. This could include medical records, witness statements, photos or video evidence.
  5. Your claim is submitted - The claim is sent to your employer's insurer, so they know you intend to claim compensation for your injury. The claims process and timeline depend on the complexity of your case and whether the other side deny or accept the liability. Either way, your legal team will be by your side every step of the way.
  6. Your claim is settled - If your factory accident claim is successful, you'll receive compensation from the other side's insurer. Your legal team will take a pre-agreed fee from your final compensation amount. If, in the rare situation your claim is not successful, you won't pay your legal team anything.

FAQs

Most claims must be made within three years of the injury taking place but there are exceptions for certain types of claims, such as those on behalf of a child. If this applies to you, please contact us so we can give you the right information about your case.

You need to have started court proceedings or settled your claim within the three years. Remember, it's better to start the claims process as soon as possible to make sure there's enough time to get you the compensation you deserve.

It's possible to make a claim on behalf of a loved one in certain circumstances. You can claim on behalf of a person under the age of 18 at any time up until their 18th birthday. After this, the usual three-year limit applies and they will need to claim themselves by their 21st birthday.

You can also claim compensation for someone unable to do so themselves due to their injuries, such as a brain injury. But if the person regains mental capacity, even for a short time, then the usual three year time limit will apply from the date they regained capacity.

If you want to claim on behalf of someone else, you can give me a call on [Medtel] and I'll talk to you in more detail about the process.

In most cases, your claim can be taken on a no win no fee basis, which means you'll only pay a fee if your claim is successful. A no-upfront-cost insurance policy will be taken out before starting a claim which gives you peace of mind and protects you from costs such as legal expenses. So, if for any reason your claim is unsuccessful and you stick to the terms of your agreement, you won’t pay any fees.

The solicitors we partner with are open and honest so you'll know exactly what fees you'll need to pay should you receive compensation. This will be discussed with you at the very start of your claim.
